1 General
1.1 The Customer acknowledges and agrees that the Conditions excluding or restricting any liability (legal responsibility) of the Company are reasonable and in regard to the existence of alternatives available to it.
1.2 The Company reserves the right to withdraw the Website without prior notice and also to refuse to accept and/or perform any orders placed thereon.
2 Charges / Payments / Damages
2.1 All charges quoted are exclusive of value added tax and all other duties or taxes which may become due or payable from time to time and shall be added to invoices at the rate applicable at the date of invoice.
2.2 Credit card payments are entitled to addition of 3%
2.3 In accordance with the British law smoking is not permitted in any of our vehicles.
2.4 Reservations can be subject to extended waiting periods, parking lot fees or tariffs.
2.5 Any damage developed by negligence or drunkennessness of the passenger , will be charged with the damage price plus additionally 300 Pound per half day, on which the vehicle concerned must be taken off road because of repair work etc.
2.6 The company ' KoelBerry Ltd.' keeps the right (and transfers this right to its drivers) to refuse the transport of presumed persons under alcohol or drug influence or of persons' behavior seen as a threat for the driver, other passengers or the vehicle.
2.7 The company ' KoelBerry Ltd.' does not tolerate any verbal or physical encroachments in relation to the driver or other cooperating workers and in such cases the responsible authorities (police) will be informimed mediately.
3 (Pre-)Booking
3.1 Each Booking by the Customer to the Company shall be carried out by the Customer to the Company by telephone, e-mail or online by the Website (or through a third party platform).
3.2 KoelBerry offers its services only over Pre-Booking.
3.3 Reservations can be subject to extended waiting periods, parking lot fees or tariffs.
4 Cancellation
4.1 Cancellations made within less than 48 hours before reservation time are be subject to a 50% cancellation fee.
4.2 Cancellations made within less than 24 hours before reservation time are be subject to a 100% cancellation fee.
5 Service
5.1 The Company will use all sensible and reasonable efforts to collect the passenger within the time specified for collection.
5.2 The Company shall carry the passengers to the given destination address.
5.3 No animals (exemption can be made for guide dogs) may be carried without the prior notice of customer and written agreement of the Company
5.4 The Company is responsible for the safety of the vehicle and any passenger who travels within it. The passenger is expected to meet the terms and comply with legislation applicable to being a passenger in a motor vehicle; and shall be legally responsible and liable for any failure by it to act in accordance with; and comply with all related legislation including (without limitation) any health and safety legislation.
6 Website
6.1 The information provided and listed on the Website has not been written with the intention to meet specific Customer requirements. It is alone the responsibility of the Customer to satisfy itself that the service ordered will be suitable for its requirements.
6.2 Whilst the Company makes all reasonable attempts to exclude viruses from the Website, it cannot ensure that the Website will be virus free.
6.3 ' KoelBerry Ltd.' permits printing, copying from and downloading excerpts from our web page exclusively for legal, personal, non-commercial intended purposes, such as:
6.3.1 No text, document, diagram or other contents of the side may be changed under any circumstances
6.3.2 No diagrams/pictures of the side are used
6.3.3 In all copies the copyright of notes of our enterprise and its authorisation notice have to appear
6.4 The company ' KoelBerry Ltd.' cannot be sued for it, if the web page for any reasons should not be callable at certain times or periods
7 Alterations to the Terms & Conditions
7.1 The Company reserves the right to change or alter these Terms & Conditions at its absolute discretion upon giving reasonable notice to the Customer and without injustice to the generality; the Company reserves the right to change the List of Charges.
8 Miscellaneous
8.1 The Company (KoelBerry Limited) accepts to comply with all provisions of the Data Protection Act 1998 as applicable.
9 London to Frankfurt / Frankfurt to London
9.1 All journeys are subject to the following conditions:
9.1.1 Full number of passengers for a VAN (6-7 persons) *
9.1.2 Full number of passengers in the case of car (4 persons)
Definition: The journey ' London to Frankfurt/Frankfurt to London' can be cancelled at any time, should a full number of passengers not come or also from other reasons.
9.2 Final travel confirmations are announced on the day before the journey.
9.3 A normal suit-case is permitted plus a small piece of hand baggage, depending upon motor vehicle type.
9.4 Additional Luggage or special requirements like child seat etc. must be informed at least 24 hours before the journey. Thereby extra charges will result.
9.5 Only Pre-Bookings.
9.6 Payments (Cash) always in advance and locally.
10 Courier Service
Items that are forbidden for transport or storage
The company KoelBerry Ltd. rejects the following goods for transport or storage, unless it is authorised by an executive committee of the company in written form and gave permission to the passenger before or before it was not confirmed in writing, that any loss that the customer from carelessness on the part of the enterprise results has to answer for that himself and the company cannot be sued for it:
a) Dangerous items, inflammable goods or
b) Firearms, tobacco, art objects, decoration, cash, glass, commodity (incl. cheques or coupons of high value), precious metals, antiques, skins etc. valuable, wines, beer, liquor, living or dead animals, fish, birds or other alive organisms of most diverse kind, frozen or easily perishable food, or
c) Any goods by law or resolution the any government or a local or public authority have forbidden, depending upon country into these goods to be transported.
Guarantee of the customer
a) The customer ensures that all goods are duly packed and marked, and that the inscription contains complete address and postal zip code both the sender and the receiver.
b) The customer ensures irrevocably for everything at material, Kraft and Unterstützung to ensure (which does not contain at the company the employee driver!) to the loading and unloading the supply at the admission and delivery place specified by the customer one needs. The customer is in addition obligates the company any damage or disadvantage, which results from the disregard of this regulation, in agreement with paragraph 13, to compensate.
Confirmations of the delivery
The company will sign a document, which the sender makes on demands, with which the assumption of the delivery property is confirmed. Such documents are thereby no confirmation for the condition or the correctness of the data to the supply, incl. quantity and weight of the delivery property at the time of the assumption
